Parents have an ongoing duty to financially maintain their children, even when separated. It is usually better for the parties to make an arrangement between themselves, but frequently this is not possible.

The Child Support Act 1991 and Schedule 1 of the Children Act 1989 govern issues regarding child support.  The Acts deal with different types of applications for finances for children and it is important to know what type of application you wish to make.

Child maintenance is now dealt with by the Child Maintenance Service – the Child Support Agency are no longer accepting new applications.  There is a basic rate calculation and there are government calculators available online for people to check what their liability might be.  It is worthwhile noting that using the CMS will cost both parents a fee.
