A non-molestation order is a type of injunction issued by the Family Court under the Family Law Act 1996. It\u2019s designed to protect individuals and children from harassment, threats, or abuse by someone they are, or were, close to.<\/p>\n<\/div>\n\n\n\n

Who Can Apply<\/strong><\/p>\n\n\n\n

\n

You can apply if the person you want protection from is an \u201cassociated person,\u201d which includes:<\/p>\n\n\n\n

<\/path><\/svg><\/span>A current or former spouse or civil partner<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>A partner you’ve lived with<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Someone you’ve had an intimate relationship with<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>A family member<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>The other parent of your child<\/span><\/div>\n\n\n\n

Application Process<\/strong><\/p>\n\n\n\n

<\/path><\/svg><\/span>Emergency (without notice) applications: if there’s an immediate risk, the court can issue an order without informing the respondent first.<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Standard applications: both parties attend a hearing<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Supporting evidence: you’ll need a witness statement detailing incidents, risks and why protection is needed.<\/span><\/div>\n\n\n\n
