Unfortunately, people find out this isn\u2019t the case, just when they are separating and asking what their financial rights are.  <\/p>\n<\/div>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-0087b346b8817d2287be6cd8101c65b6\" style=\"color:#15446b\">I need to be clear, in England &amp; Wales there is no such thing as a \u201ccommon law marriage\u201d. This idea arose out of the misconceived idea that couples who have lived together for a certain number of years would automatically acquire the same legal rights as married couples. It\u2019s a myth, and a rather insidious persistent one at that.  It can, after all, have long term, very serious consequences.<\/p>\n<\/div>\n\n\n\n<p class=\"has-vivid-green-cyan-color has-text-color has-link-color wp-elements-22c86c9df27a2ad4e15a62df2e920567\"><strong>What Is Cohabitation?<\/strong><\/p>\n<\/div>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-4cba7a57b1393822ec53cfa3f9390fdf\" style=\"color:#15446b\">Cohabitation simply means living together as a couple without being married or in a civil partnership. It\u2019s increasingly common: cohabiting couples are now the fastest-growing family type in the UK. Unfortunately for those that choose this route, the law has not kept pace and therefore doesn\u2019t recognise this type of relationship in the same way as it does marriage\/CP.<\/p>\n<\/div>\n\n\n\n<p class=\"has-vivid-green-cyan-color has-text-color has-link-color wp-elements-f658e1b139af7c99def470240081bf0c\"><strong>The \u2018Common Law Marriage\u2019 Myth<\/strong><\/p>\n<\/div>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-b626b3bad17f5893766c3cb7cb628c59\" style=\"color:#15446b\">Many people assume that if they\u2019ve lived with their partner for a long time (for some they think it is as little as two years) especially if they have children or share a home, that they become a \u201ccommon law husband or wife.\u201d  There is no legal standing to this term in England and Wales.<\/p>\n<\/div>\n\n\n\n<p class=\"has-vivid-green-cyan-color has-text-color has-link-color wp-elements-692a7b8a21164535cd45e00d3623d451\"><strong>Living together does not give you automatic rights to:<\/strong><\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-icon-list ends<\/span><\/div>\n<\/div><\/div>\n<\/div>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-5a6e1316253a3d238e840450bc6faebd\" style=\"color:#15446b\">Even if you\u2019ve contributed to household bills or raised children together, you may have no legal claim unless your name is on the property title or you can prove a specific financial agreement.<\/p>\n<\/div>\n\n\n\n<p class=\"has-vivid-green-cyan-color has-text-color has-link-color wp-elements-27bbebdb610536ddced974a0e38f94fe\"><strong>Property and Financial Risks<\/strong><\/p>\n<\/div>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-780e1467b562071d57a61d275342c4d5\" style=\"color:#15446b\">If the home is in one partner\u2019s name, the other may have no right to stay or claim a share if the relationship breaks down. Claims can sometimes be made under trust law, such as constructive trusts or proprietary estoppel, but these are complex, costly, and uncertain. There is potential to gain more time to remain in the home via an occupation order, but this does not confer ownership in any way.<\/p>\n<\/div>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-3a9d66cb992fb53d36fd1d13a81da6a1\" style=\"color:#15446b\">Similarly, if one partner dies without a will, the surviving partner may inherit nothing, even if they\u2019ve lived together for decades.<\/p>\n<\/div>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-2116065455183c96cdf1d573df5b4a25\" style=\"color:#15446b\">Reform is probably needed in these modern times, in order to take into account the different types of family set up.
