Interview Under Caution<\/strong><\/p>\n\n\n\n

A DWP interview under caution (IUC) is a formal, recorded meeting conducted by the Department for Work and Pensions when they suspect someone may have committed benefit fraud. Unlike routine compliance checks which we discussed in Part II of this Benefit series, this type of interview signals that the matter is being investigated under the Police and Criminal Evidence Act (PACE), however it is an interview specific to the DWP to investigate benefit fraud or overpayments.<\/p>\n<\/div>\n\n\n\n

Why have I been invited to an IUC?<\/strong><\/p>\n<\/div>\n\n\n\n

The reasons for being invited to an IUC could be because: <\/p>\n<\/div>\n\n\n\n

\n
<\/path><\/svg><\/span>There are discrepancies in your financial records, such as undeclared income or savings<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>You\u2019ve failed to report a change in circumstances, such as moving in with a partner or starting work<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>The DWP has received a tip off from someone or matched data from HMRC, banks, or other agencies that flagged a discrepancy<\/span><\/div>\n<\/div><\/div>\n<\/div>\n\n\n\n

This interview is not informal, it is a serious matter and is part of an evidence gathering process that could lead to prosecution.<\/p>\n<\/div>\n\n\n\n

You should consider instructing a solicitor to attend the interview with you, to provide guidance during the interview and help you to prepare your defence.<\/p>\n<\/div>\n\n\n\n

What is going to happen in the interview?<\/strong><\/p>\n\n\n\n

Before the interview begins, the Fraud Investigation Officer (FIO) who works for the DWP, will read you your rights. This from PACE (Police and Criminal Evidence Act) and is a formal caution, which includes the phrase:<\/p>\n<\/div>\n\n\n\n

\u201cYou do not have to say anything, but it may harm your defence if you do not mention when questioned something which you later rely on in court.\u201d<\/em><\/p>\n<\/div>\n\n\n\n

This means:<\/strong><\/p>\n<\/div>\n\n\n\n

<\/path><\/svg><\/span>You\u2019re not obliged to answer questions<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>If you do give answers, anything you say can be used in court<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>You have the right to legal representation (a solicitor)<\/span><\/div>\n<\/div><\/div>\n\n\n\n

The interview is audio-recorded in accordance with PACE. The FIO will ask detailed questions about your benefit claim, finances, living arrangements, and any inconsistencies they\u2019ve identified.<\/p>\n\n\n\n

Will I need to bring anything with me?<\/strong><\/p>\n<\/div>\n<\/div>\n<\/div>\n\n\n\n

The one thing you should take with you is a solicitor.  If you choose not to, then follow the list of the information the DWP have asked you to bring. This may include:<\/p>\n\n\n\n

<\/path><\/svg><\/span>Usually up to 12 months worth of bank statements for all your accounts<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Payslips or proof of income<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Tenancy agreements or mortgage documents<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Evidence of gifts, inheritances, or large deposits<\/span><\/div>\n<\/div><\/div>\n<\/div>\n\n\n\n

Do I really need a solicitor?<\/strong><\/p>\n<\/div>\n\n\n\n

You have the right to bring a solicitor or legal adviser, but you are obviously free to choose not to use one.  We always recommend it, as they can:<\/p>\n<\/div>\n<\/div>\n\n\n\n

<\/path><\/svg><\/span>Ensure the interview is conducted lawfully<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Help you understand your rights<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Advise whether to answer questions or remain silent<\/span><\/div>\n<\/div><\/div>\n<\/div>\n\n\n\n

If you haven\u2019t secured representation, you can request to reschedule the interview.<\/p>\n<\/div>\n\n\n\n

What will happen once the interview is complete?<\/strong><\/p>\n\n\n\n

Following the interview, the DWP may:<\/p>\n\n\n\n

\n
<\/path><\/svg><\/span>Decide no further action is needed<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Reassess your benefits and demand repayment of any overpaid amounts<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Issue a civil penalty which can be between \u00a3350 and \u00a35,000<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Refer your case for criminal prosecution<\/span><\/div>\n<\/div><\/div>\n\n\n\n

If you are prosecuted and subsequently convicted, your benefits may be reduced or stopped for up to three years depending on the severity and frequency of the fraud.<\/p>\n\n\n\n

Our Advice<\/strong><\/p>\n\n\n\n

<\/path><\/svg><\/span>Don\u2019t ignore the invitation to the IUC, respond promptly<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Seek legal advice before attending and preferably arrange a solicitor to attend with you<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Be honest, but don\u2019t guess or speculate as to what information the DWP might have<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Keep records of all correspondence and documents<\/span><\/div>\n<\/div><\/div>\n\n\n\n

Clearly, facing a DWP IUC is going to be daunting, and potentially frightening, causing you to feel stress and anxiety, but preparation and proper support from a legal professional can make a significant difference.<\/p>\n\n\n\n
