Occupational Rent<\/strong><\/p>\n\n\n\n

When couples separate, one of the most common sources of tension is the family home. If the property is jointly owned but only one person remains living there, the question arises: should the non-occupying owner be compensated? That\u2019s where occupational rent comes in.<\/p>\n<\/div>\n\n\n\n

What is occupational rent?<\/strong><\/p>\n\n\n\n

It\u2019s rent, as it says, but as a form of compensation paid by one co-owner of a property to another when they live in the home alone. It\u2019s not automatic and it will depend on the specific circumstances for the parties, and can be decided by a court.<\/p>\n<\/div>\n\n\n\n

When can it be claimed?<\/strong><\/p>\n<\/div>\n\n\n\n

Occupational rent is usually considered during financial proceedings following divorce or separation. It may be awarded if:<\/p>\n<\/div>\n\n\n\n

<\/path><\/svg><\/span>One party was excluded from the property (either physically or constructively)<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>The remaining party had sole benefit of the home<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>There was no agreement allowing the sole occupation<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>The non-occupying party continued to contribute financially (e.g. mortgage payments)<\/span><\/div>\n<\/div><\/div>\n\n\n\n

The court will look at fairness, the reason for the exclusion, and whether children were living in the home.<\/p>\n\n\n\n

What is \u201cConstructive Exclusion\u201d?<\/strong><\/p>\n\n\n\n

Constructive exclusion doesn\u2019t just mean when someone is physically locked out of property, it can also mean they were made to feel they couldn\u2019t reasonably live in the property anymore. This could include:<\/p>\n<\/div>\n\n\n\n

<\/path><\/svg><\/span>Creating an unsafe or hostile environment<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Denying access to basic amenities<\/span><\/div>\n<\/div><\/div>\n<\/div>\n<\/div>\n\n\n\n

If someone leaves the home because they feel they have no choice, the court may treat that as an exclusion.<\/p>\n<\/div>\n\n\n\n

How is rent in these circumstances calculated?<\/strong><\/p>\n<\/div>\n\n\n\n

There\u2019s no rigid formula, however, courts will often start with the market rental value of the property and divide it based on ownership shares. For example:<\/p>\n<\/div>\n\n\n\n

<\/path><\/svg><\/span>If the home would rent for \u00a31,200 per month and each party owns 50%, the non-occupying party might be able to claim \u00a3600 per month.<\/span><\/div>\n\n\n\n
<\/path><\/svg><\/span>Adjustments may be made depending on who paid the mortgage, whether children were present, and various other considerations.<\/span><\/div>\n\n\n\n

Will it be backdated?<\/strong><\/p>\n\n\n\n

In some cases the court will consider backdating such payments. If the court finds that one party was unfairly excluded, it may award occupational rent from the date of departure. However, this is discretionary and will depend entirely on the facts of the individual case.<\/p>\n\n\n\n
