Ask A Question T&Cs

These Terms and Conditions are specific for the Ask A Question Product available online via email or chat only.

Clients who instruct No.53 Legal Limited directly will receive a client care letter detailing the terms and conditions that are pertinent to their instructions within that, and can also see an overview of those T&Cs here.

1. Acceptance of Terms & Conditions
Welcome to No.53 Legal Limited’s ‘Ask A Question’ service. It is owned and operated by No.53 Legal Limited, an authorised and regulated alternative business structure law firm. We are authorised and regulated by the Solicitors Regulation Authority. ‘We’ or ‘Us’ refers to No.53 Legal Limited.

“User”, “you” and “your” refer to the individual or entity that uses our Ask A Question page. “Customer” refers to the person who asks a question on our site. “Lawyer” or “Expert” refers to the person who answers the question, or makes a call from the Ask A Question page. The Terms & Conditions apply to both ‘customer’ and ‘lawyer/expert’.

By using the Ask A Question page by booking and paying for a service, you are agreeing to accept these terms & conditions, and you consent to the collection, use, disclosure and other handling of your data for the purposes as described in our privacy and confidentiality policies listed elsewhere on the site. You also agree to comply with the rules, policies and disclaimers posted on the site or about which you are notified. Logging in and registering requires you to acknowledge these T&Cs.

2. Ask A Question
Our Ask A Question page is hosted on our main business website at No53legal.uk.

It is an online page that allows you, the customer, to choose and pay for an Ask A Question option that suits your needs, either a chat online (during opening hours) or an email. Using this service does not denote legal advice. It is what is known as an unbundled service, allowing us to provide you with information and guidance on your question. It is for guidance, educational and informational purposes only. If you need legal advice, which is distinct from the Ask A Question option, you can email us via the site, and we can book you in for a legal consultation.

Users of the Ask A Question page will receive a response via their chosen option, either an online chat or an email. There is no obligation for such customers to book or pay for anything other than their chosen option. The communication is complete within the service purchased.

Our responsibility to you, the customer, is limited to providing an accurate information and guidance response to your query. We are not instructed by you and we do not represent you. If you wish to instruct us or have representation, you can contact us here: Contact Us.

Real people are at the end of the chat or email, and your query will always have the input of a human.

We use all reasonable skill and care in providing our Ask A Question service, and always act with due diligence.

Our lawyers are registered with SRA or BSB (Solicitors Regulation Authority or Bar Standards Board). We do not have any third party providers. You acknowledge that No.53 Legal Limited is not liable for any loss or damages caused by your reliance on any information provided. If you wish to rely on the information provided, please instruct us instead, use the Contact Us page and we will be happy to provide an estimate of legal costs for your case. If you choose to instruct us, you will become our client and will receive a client care letter outlining your instructions, our T&Cs and payment terms.

Ask A Question answers are to be used by Customers solely for information and guidance purposes and not as a substitute for legal advice. The answers are general information about the law and not legal advice, nor a specific course of action for a customer; they are options that may be available to the customer in their circumstances. If you need actual legal advice and specific guidance on what to do it is important to instruct us. You can use the Contact Us page to make initial contact.

There is no lawyer/client relationship formed by the Ask A Question page. If you wish to create a lawyer/client relationship, please do feel free to instruct us to legally advise on your case. You can do so using the Contact Us page.

Communications on the Ask A Question page are only accessible to those who pay have paid to have their query answered. Chat and email queries are confidential as only you will have access to the response we provide.

3. Additional Services
It is possible for you to request additional services beyond the Ask A Question page. These may be offered at fixed rate options dependent on the service required. Currently they do not appear in our shop, but may do in the future. In the meantime, you can use the Contact Us page to ask for additional services, such as document review, document drafting, form filling and so forth.

Additional services are also unbundled services and do not constitute legal advice, unless it has been expressly stated as such (in which case you will have instructed us and received a client care letter detailing your instructions and our terms and conditions). 4. Fair Use Policy
The information and guidance provided to you on the Ask A Question page is for your use, based on the information you have provided to us. You should not use it to attempt to provide information or guidance to others. You can direct them to ask their own question on our page. Sometimes subtle differences in the query may result in the query requiring different information to your own.

5. Modification of Terms & Conditions
No.53 Legal Limited may make changes to these T&Cs, if there are changes in the law or our regulation, or changes in circumstances that go beyond our control. It is unlikely such changes will affect our Ask A Question customers, since these are instant services based on chat or email, but if they do have an effect, we will inform such customers immediately, and before any services are provided. If such changes affect the service being provided, a refund can be issued.

No.53 Legal Limited may terminate or suspend, either permanently or otherwise, the services offered on the Ask A Question page. As the service is ad hoc and available on the website, there will not be advanced notice of a termination or suspension, the options will merely not be available online, but an explanation as to when or if they will be re-instated may appear on the page instead.

6. Eligibility
Anyone over the age of 18 can Ask A Question. They will need a debit or credit card, or access to Apple Pay or Google Pay to do so. We do not accept Paypal or any kind of credit payments for these services as we are not permitted to do that. Minors can only use the service under the supervision and guidance of an adult over the age of 18.

You do not need to create an account to Ask A Question, but you will need to provide your name, address, email address and your credit/debit card details to pay for the question. You agree to provide accurate and verifiable information to Ask A Question. The data will be used solely to process your request to us. You agree to comply with the billing procedures. The service is non transferable. We have no obligation, when offering unbundled services, to ask you to provide identification (this is not the case if you instruct us directly), but we will ask for evidence if required to protect the safety and security of our Ask A Question service and users.

7. Chats, emails and calls
Chats and emails made under the Ask A Question page are not subject to lawyer/client privilege as they are for information and education purposes only, and do not constitute legal advice. They are therefore not confidential, however we do not publish emails or chats, therefore the only person who has access to the information provided is you.

Otherwise we retain a non-exclusive, royalty free right to exercise the copyright, publicity and database rights of all derivative works that appear on our website.

8. Restrictions
As a condition of the Ask A Question page, you agree to not use it for any purpose that is unlawful or restricted by these T&Cs, or any other purpose not reasonably intended by No.53 Legal Limited.

By way of example:

There is no establishment of a professional-client relationship on the Ask A Question page;
You will not use the Ask A Question page for purposes of plagiarism in any context or in cheating in an academic setting;
Create multiple Accounts on the Ask A Question Page.
Use another User’s account to access the Ask A Question page or permit another person to use or access your Account;
Use methods to disguise your location
Directly or indirectly submit any questions or otherwise engage in conduct that is fraudulent, inaccurate, infringing, libellous, defamatory, abusive, offensive, obscene, pornographic or otherwise violates any law or right of No.53 Legal Limited or Users or any other third party, including privacy rights, copyrights, or other intellectual property right;
Directly or indirectly submit any questions linking to affiliate programs, multi-level marketing schemes, or off-topic content;
Engage in any behaviour that is against the law, defamatory, trade libellous, unlawfully threatening or unlawfully harassing;
Submit any content containing any viruses, Trojan horses, or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
Submit any questions that advocate illegal activity or discuss illegal activities with the intent to commit them;
Engage in any activity that could cause us to violate any applicable law, statute, ordinance, or regulation;
Resell or make any commercial use of our system or the content on the Platform, including personal information, without our prior written consent;
Falsely imply Ask A Question’s endorsement, partnership, employment, or otherwise mislead others as to your affiliation with our site or law firm;
Use the Ask A Question page in a way that violates or facilitates violations of these Terms, any other agreement or guidelines that govern use of the page or attempt to do any of the foregoing directly or indirectly;

9. Copyright Infringement
We will disable or terminate the Accounts of Users when we become aware of an intellectual property infringement. If you believe that your copyright or the copyright of a person on whose behalf you are authorised to act has been infringed, please Contact Us.

10. Fees, Refunds and Cancellation Policies
Customers are offered chat or email options for the Ask A Question service depending on whether we are online or not. Your answer will be provided live via chat (if we are online) or via email within 24 hours of submission of the query.

These are individual, stand alone options. There is no ongoing membership required, and we will not take further payments from you. If you wish to purchase another of the Ask A Question services, that too will be a stand alone option. We do offer memberships for those who wish to ask a fixed number of questions per month, please contact us to ask.

Refunds are only available where the information and guidance provided is proven to be wrong.

If you think this is the case with a response you received, email us with the relevant information, and we will assess the response you were given.

Otherwise, as this is a service provided for the fee you pay, refunds are not available. We cannot, after all, take our service back.

Until or unless we provide account services, each Ask A Question fee is for the individual query asked and is not an ongoing service. I.e. the question is self contained, and will receive one answer. In the case of a chat, the lawyer is likely to ask questions, and will provide an answer once he or she has gathered all relevant information.

We have no sign up fees. You pay for the Ask A Question option you choose and have no further obligation to buy anything more from us, or to instruct us formally on your legal case. You can choose to purchase a membership if you wish, see above.

You can only cancel an Ask A Question chat, phone or email purchase if you do so before we have engaged with you.

The Ask A Question page will reflect any special offers we may have on at any given time.

11. Payment Information
You will only provide payment information that is accurate and that you are authorised to use, i.e. your own payment method. You are responsible for ensuring that you have sufficient funds to make payment for the service you choose. You make all payments via the checkout.

12. Proprietary Rights and Limited License
All rights, title, and interest in and to the Ask A Question page are and will remain the exclusive property of No.53 Legal Limited and its directors. All materials herein, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all intellectual property rights related thereto, are the exclusive property of No.53 Legal Limited. The site is protected by copyright, trademark, and other laws of England & Wales.

13. Duration
Ask A Question is limited to the service you choose and pay for. Therefore once the service has been provided to you, you have no further obligation to engage with us. You can, of course, Ask A Question as many times as you wish using our online shop, or purchase a membership.

There is no need to terminate, as the Ask A Question is standalone.

We reserve the right to cancel a question via email, chat or phone call if we deem it appropriate to do so based on customer conduct. We will not provide refunds in these circumstances. We will email you, if we have your email address, to explain why we withdrew, it will not be an invitation for you to engage further with us, and will be determined as the end of our contact.

14. Limitation of Liability
To the fullest extent allowed by local law, under no circumstances shall No.53 Legal Limited be liable to you or to any other person for any indirect, special, incidental, exemplary, punitive, or consequential damages of any kind, even if advised of the possibility of such damages. As required by certain local jurisdictions, nothing in these Terms will limit our liability (a) when we were negligent and this led to death or personal injury; (b) in case of fraud or fraudulent misrepresentation; (c) in respect of gross negligence or wilful misconduct; or (d) if such liability can otherwise not lawfully be limited or excluded.

15. Dispute Resolution
If you have a dispute, please do contact us to discuss it further. Use our Contact Us page. We will do our utmost to resolve your concerns.

16. Applicable Law
These T&Cs and our services are governed by, and construed in accordance with, the law of England & Wales.

17. Miscellaneous
Customers for the Ask A Question page are bound by these T&Cs and the privacy policy on the site, which forms the entire agreement for the use of the Ask A Question page. Such customers are not clients of No.53 Legal Limited (our clients receive a client care letter).

The T&Cs are personal to you, and are not assignable or transferrable.
